There are a wide range of procedures that can be utilized to introduce data that has been found during an insight examination. Different graphs can be utilized to dissect the courses of events, crimes, money related exercises, or true to life profiles to demonstrate or discredit legal direct of the individual or the association. The action stream outline shows the various advances that have been taken in an unpredictable activity. By separating the means, it gets simpler for the expert and law implementation associations to distinguish the offense of a confounded activity. The movement stream diagram is likewise utilized alongside different outlines to help further show plausible action. Evaluations are made after and during a key examination. These appraisals help to move from an expansive or all around characterized position and further research nearer to the source(s). There are two sorts of evaluations: General and Specific. A general evaluation gives an outline while a particular appraisal can uncover dangers and vulnerabilities. An Association examination is utilized to show the connections between individuals, gatherings, or associations to show criminal or non-crime. The affiliation grid is utilized as a between time item that incorporates police reports, reconnaissance reports, field interviews, corporate records, declaration, source information, open record information, and other data. The affiliation examination can be utilized to show other conceivable crime. The affiliation graph is utilized related to the affiliation examination to delineate connections. How the outline is utilized can give new data about a system or the operational method of an intrigue. So as to decipher the affiliation diagram, a couple of systems must be comprehended. To start with, the individual in the focal point of the diagram may not be the leader of the crime or connivance. Probably, this individual may only be the most effortless individual to contact and track by the investigator. Second, the affiliation graph is just a preview and connections may change from everyday. An affiliation grid is diagram comprised of lines and sections delineating each relationship that an individual has. Data is taken from analytical reports, open records, and declaration. Every individual that is related will likewise have the same number of referred to different connections also. Another sort of an investigation that can be used is the bank record examination. This is essentially following the cash trail and following how much cash is being spent. The cash that is spent can lead straightforwardly to different substances that may should be revealed so as to draw a reasonable picture about a crime. This kind of examination can reveal unlawful salary, skimming, business extortion, or tax evasion. The utilization of timetable occasions is likewise useful in drawing an image of exercises happening over some undefined time frame. There are two or three different ways to utilize a timetable. One can be utilized to pass judgment on a people or an associations crime from ever yday and another can be utilized to show an example in a zone of comparative crime. The last can be utilized to evaluate the danger or powerlessness of a specific region. The phone record investigation is utilized to discover more data about whom the suspect is reaching. The information can be produced from phone bills or non-sound wire catches (dialed numbered recorders or pen registers). A dialed number recorder (DNR) machine will give data on all the numbers that are a produced using a phone line. Monitoring the calls produced using realized hoodlums can open ways to discovering new obscure plotters. A phone record diagram is an apparatus used to outwardly observe the entirety of the calls produced using one or a few lines. Ordinarily, a few phone records will be acquired to exhibit the to and fro calls just as calls made to different sources. The visual graph is more obvious than sheets of composed data and ought to be broke down to decide its importance. Puritans EssaySome rules for an oral report are discover how much time is assigned, recognize the crowd, plan the brief, pick the key focuses, create designs for introduction, retain sources/documentation for material in visuals, create potential inquiries, and practice. The three keys referenced above alongside the rules will empower any investigator to give an oral report that won't put the crowd to bed. Presumably the most significant rule is to distinguish the crowd. You won't have the option to discuss the material science engaged with the examination to a gathering of road cops, subsequently you should keep the data essential as long as you come to your meaningful conclusion and dont forget about anything. Security encompasses the knowledge procedure. There are a wide range of sorts of security, the first being activities security. Tasks security is the controlling of any realities about an activity/movement to abstain from trading off the whole activity. The means that can be audited before or during the arranging of a law requirement activity are distinguishing basic data, directing a danger examination, playing out a helplessness investigation, applying countermeasures. A countermeasure is whatever is done to counter the adversarys capacity to access or endeavor your data. Single direction to bargain a whole activity is to uncover only a tad of data about it. In the event that you tell a little and another person says a little and another releases a little, at that point the whole activity will be known whether an inappropriate individual assembles everything. The most ideal approach to stay away from an activity being undermined is to not spill anything by any stretch of the imagin ation. The job of counterintelligence in law authorization is to actualize countermeasures and to attempt to discover what the criminal could conceivably think about any activity. The counterintelligence official is fundamentally the balanced governance of the office. Their main responsibility is to shield the office from trading off data just as acquiring as much insight about the adversarys information too. Correspondence security includes cryptography, transmission security, and so on; and physical security is the real door watch and physical hindrances that square unclassified work force from getting any data. The utilization of records security is another approach to guarantee that unclassified work force know that the thing that they might be attempting to take a gander at is characterized, and every single grouped thing ought to be obviously set apart so as to evade any disarray. Insight revealing and security are not basic undertakings and do merit a ton of consideration. With the goal for data to be accounted for effectively it must be examined/gathered and broke down with an impartial eye. A great deal of times an agent has a sole motivation behind sentencing a suspect, while the investigator has a sole reason for getting and transferring however much data about a subject as could reasonably be expected. The investigator must remember that all realities ought to be uncovered to fitting staff and after prepared, shielded from anybody that doesn't have the need or the option to know. It has always been the common acceptance that by putting more offenders in jail, crime statistics will decrease. This belief led congress to enact the anti-drug abuse act of 1986. At first, it was believed that this seemed to work, due to there being a ââ¬Å"5% drop in crime in the 1990ââ¬â¢sâ⬠(Chettiar). Author Background: The name of the author of the article Conversation in the Odyssey is Scott Richardson. Scott Richardson is a professor of classics. He teaches at the College of Saint Benedict and Saint Johns University in Minnesota. Donââ¬â¢t waste time! Our writers will create an original "Conversation In The Odyssey By S.Richardson" essay for you Create order He has a B.A in Classics from Harvard University, an M.A from Harvard University, and a Ph.D. in Comparative Literature, from Stanford University. Scott Richardsons educational background is a bachelor from Harvard University in 1978, Master of arts from Stanford University in 1980, and a Doctor of Philosophy from Stanford University in 1984. He teaches Latin and Greek and Human Languages and Culture. He is an assistant professor of classics at Saint Johns university and is an associate professor at Saint Johns university. Scott Richardson has interests in writing about the authors Homer, the Greek playwrights, Fyodor Dostoevsky, James Joyce, Dorothy Dunnett, Thomas Pynchon, and the writers of Icelandic sagas. Another work done by Scott Richardson is The Homeric Narrator, a book that he published. He also has written other articles on Homer. He does not have an active twitter or other social media accounts. Scott Richardsons teaching and research interests are Greek and Latin languag e, Greek and Latin literature, European and American literature (especially Scandinavian and British), and narrative theory. Analysis: The thesis statement of the article is the various conversations in the Odyssey. The article is about what is spoken by both parties that is not truly conveyed. The concluding statement that the author makes is that conversation in the Odyssey is a cryptic puzzle, intelligible and rewarding to those who know how to solve it, baffling to those who take it at face value. Summary: One claim that Scott makes is that the bulk of dialogue that is straightforward and honest comes from the mouths of characters who prove in other ways articles: Zeus, Nestor, the servants, and the suitors. The author supports the claim mentioned by stating that Zeus and nestor, the divine and human voices of social and narrative order, stand above the game of saying something in a conversation, and not stating exactly what you mean to say or what you want the person you are having a conversation with understand. Richardson came to that conclusion because a great majority of conversations in the Odyssey featu re indirect address, impolication, hidden, or coded meaning, lying, feigned, ignorance, secrecy, concealment of facts, end expressions of disbelief. In Richardsons article, Conversation in the Odyssey, he makes a second claim. The second claim was that Odysseus, a suspicious man, is the champion of all these kinds of indirection and concealment, the consummate manipulator of language to suit his advantage. He backs up his claim by saying that Nausicaa has the Odyssean instinct when she manipulates her father into giving her mules and a wagon, but she fails to see that Alcinous has seen through her request. This claim is important because in conversation, you have to be good at the game you are trying to play, so that when your conversing, you can mean something other than what you are actually saying without anyone figuring it out. A third claim that Scott Richardson makes in his article is that Penelopes indirect address to the man claiming to be her husband by way of an apparently direct statement to her son and the implication in her bed trick that she has been a faithful wife represent the two most prevalent forms of indirect communication in the Odyssey. Scott Richardson backs up his claim by saying that Penelopes entry in Book 1 marks the first instance of indirect address, which will become almost the norm in conversation with more than two people present . When Penelope berates that bard Phemius for his song about misadventure on the return from Troy, her real targets are the hateful suitors who relish the topic. This claim is important because in conversation, directly telling the other person what you mean is a better way to approach a conversation. A fourth and final claim that Scott Richardson makes is that when the point of ones word is to manipulate the situation to suit ones interests rather than to reveal and communicate, conversation is game and performance. The game of language in the Odyssey can be playful, but the perplex use of speech reflects a treacherous and precarious world in which survival and happiness depends on assuming that appearance is deceiving. Richardson backs up his claim by saying that the straightforwardness is masking a reality that must be deciphered. Those who play the game well listen carefully to what is not stated outright and express what they mean by not actually saying what they mean. This claim is important because when conversing, one can use different words to try to manipulate the other person in the conversation, which makes the conversation tricky to comprehend. Evaluation: I believe that the author of Conversation in the Odyssey, Scott Richardson, did a very good job developing their arguments. I also believe that the author is qualified to write on the subject of the Odyssey because he has a B.A in Classics from Harvard University, an M.A from Harvard University, and a Ph.D. in Comparative Literature, from Stanford University. I also believe that he is qualified to write on the subject of the Odyssey because he has interests in writing about the authors Homer, and the Greek playwrights, and has other work done by Scott Richardson is The Homeric Narrator, a book that he published, along with other articles on Homer, the author of the Odyssey. I think that Scott Richardson left out a little bit about the game that was played during conversations that he was trying to describe. I am convinced of their argument by the end of the article. A passage that was referenced in the article is, Then, when the wheeling seasons brought the fourth year on, one of her women, in on the queens secret, told the truth and we caught her in the act-unweaving her gorgeous web. So she finished it off. Against her will. We forcer her. This passage was described in Scott Richardsons article as a secret that Atena told Telemachus. When I read the passage while reading the Odyssey, I interpreted it the same way. Scott Richardson really stuck to his argument, and ended up convincing me about his argument at the end of the article. I think that Scott Richardson supported his claim well, compared his examples to other situations, he gave in depth explanations, he talked about individual characters. Answer: Introduction The investors play a major part for the company to be successful in the share markets. They purchase the shares of the company to gain a long-term benefit from the company that they have invested in because of the success that the company may have in the future. They are mainly concerned with the values of the company who may be dealing with the same products at two different prices. They evaluate the company based on the financial strengths by reviewing the profit and loss statement of the company and identify the key factors for the success of the company in the present and the future before investing in the organization (Venturini and Benito 2015). For the Nutshell Customer Relationship Management (CRM) software, I have taken up the role of the investment banker by helping the company to be public so that they can raise money from the market for which I am holding the securities of the company. Analysis of the Software The CRM software helps in managing the customers of the company by handling the databases of the customers and increases the interaction level with them. It also helps in acquiring the information that is needed related to business, the sales of the company and the advertising of the products that the company offers in the market. The software also helps to support the customers and manages the relationships with the vendors and the staff members. The company can handle the customers more efficiently and effectively which will help the sales department to manage the customers, which will help the company to increase its sales (Trainor et al. 2014). The use of the software will help the company to maintain its data relating to its target customers, the preferences of the products that they have, the purchase history of the customers and all the personal information of the consumer that the company requires. The gap that is present between the sales team and the potential customers wil l be less and it will help to increase the transparency between the company and its customers. In spite of, a number of companies present in the market regarding the Customer Relations Management software, the software in mobile service is still missing and has a huge demand in the market. The software of Nutshell CRM has helped in identifying the requirements that needs to be satisfied in a business. This software has various sales tools options that help in the collective productivity of the company (Rosenbroijer 2014). SWOT Analysis of the Software Strengths The software is very useful in the small and medium enterprises because of the automatic update feature that it has which takes away the burden from the sales team to update the feature continuously. It helps to segment the products in different categories keeping the taste and preference of the customers in mind. The datas related to the products are kept safely and updates the product catalogues if any changes take place which helps in building the customer relationship with that of the company (Balaban and Dumitrascu 2014). Weaknesses The price of the software is high, as it will be used by the small-scale industries. The software to be successful in the market needs to be tested before launching it in the market is time consuming as it is not possible to get the result within a day or two. The skill that is required by the people needs to be developed with time for properly utilizing the software (Ghaffari, Delgosha and Abdolvand 2014). Opportunities The mobile services sector will be provided with this software, which will turn out to be very useful as it will help the company to have a hassle free operation. It will also save the cost of installing heavy technological goods (Balaban and Dumitrascu 2014). Threats The products such as Zoho CRM, Sugar CRM, BaseCRM and Salesforce dot com are available in the market providing a stiff competition for the new product to capture the market. The gradual changes that are happening in the global market poses grave threat to the software as the technology may get outdated and companies may look for an alternative (Ghaffari, Delgosha and Abdolvand 2014). Promotional Activities The strategies adopted for the distribution and marketing of the software is through an effective communication channel, which will be based for the target customers. It makes the customers aware of the product through phone calls and emails (Preece et al. 2015). Exit Strategy The projected income for the software is also given where after all the expenses are incurred, the company is left with a net income of worth $49,824. The exit strategy of the company will be to merge with big brands like Apple and Windows and Web based applications to provide the customers the apps through these broad platforms (Arman 2014). Recommendation of the Investor Innovation is based on sound engineering, technology, science and management because the business in the modern world is undergoing constant changes every day. The top management of leading companies employs people who can evaluate the opportunities and run the innovation process through product marketing, marketing strategy, business development and RD development. The innovation that takes place for a product is based on engineering as it helps the product to develop, technology through which the product is given a shape, science and management is required to make the product available to its target customers (Bullen, LeFave and Selig 2017). Innovation is feasible in nature and the concept is practical because feasibility analysis helps in determining whether the customers will like the business idea, or not. It helps in identifying the opportunities that is there for the product before the production process takes place. This concept is necessary for any innovative idea to be physically present in the marketplace (Pedron et al. 2016). There is a market for the product because the economy of the place also plays a vital role in launching of the product. The people can purchase the product as the rich economic places will have more purchasing power in the hands of the consumers and they can afford to spend their incomes on the luxury items as well after purchasing the necessary items. Thus, the purchasing capacities of the people play a huge role for a product to be successful in the market of a given place. The political issues needs to be seen as the rules and regulations of the regulatory bodies need to be followed so that the company does not fall in to some major trouble in the market of that region (Beggs Jr. et al. 2014). The distribution strategy followed by the CRM software is to make the customers aware through the phone calls and the emails, which are backdated in the modern world. The company needs to use the social media platform so that the customers are more aware of the product and constant updates can be received about the product. The estimated financial statement shows that the net income of the company will be around the $50,000 mark, which is good for a start-up company and shows a positive outcome in the future. The exit strategy of the software that is to merge with big brands may provide the edge to the company to have a competitive advantage over the other products that are present in the market. One of the main brand is Apple who selects its applications very carefully because it is one of the leading brands when it comes to mobile technologies in the world (Bullen, LeFave and Selig 2017). The product has a growth in the market as the profit statement that has been estimated is good enough for the start-up company and it will be sustainable in the market for quite a few years, as it will help the companies to automatically handle their business operations by using this software. The sales team plays an important part for the overall development of the company. They handle the relationships with the customers and sees that the company meets all the grievances and the demands. The objectives and the target of the company is to maximize its profit by selling the maximum number of products at a lower price as it is a start-up company. The sales team looks after the needs and the preferences of the customers and explains the product to its target customers. They are fully equipped with all the resources that are required to carry the business forward in the future (Pedron et al. 2016). Conclusion The decision that has been taken is that I have agreed to invest in the project because on reviewing the presentation I have found that there is the factor of profit in the future for the company. The software will be of huge demand for the companies as with the advancements in the technology, the manual labor force is decreasing in the company in the current times. It will be seen that the future will see more technology advances, which will reduce the manual work pressure by a large margin. This software will help in segmenting and segregating the products and the target customers according to the preference of the company and since it is automatic, there is no need to hire extra labor in maintaining the software. Terms and Conditions Being a 49 percent partner of the company by investing $500,000 worth of money Investing partially with $100,000 annually and reviewing the reports based on which the bank can withdraw its capital The profits of the firm needs to shared equally and the losses in 1:1.5 ratio where 1 belongs to the bank The Board of Directors needs to have at least two representatives that the bank elects. Yolen sets the supporter. Rebecca Berlin on a pursuit of personal find. a pursuit which is strongly connected to the yesteryear. a past which takes its roots in the holocaust. Yolen captivates the respondent through the use of the sophisticated linguistic communication techniques: fable. narrative construction. and multiple narrative voices to convey the significance of personal find. Yolen embedded personal find as a nucleus subject in the text to convey strong positions on personal find through the usage of fable to drive the narrative along giving it a sense of pragmatism. Gemmaââ¬â¢s stating and retelling of the fairy narrative is a changeless characteristic in the text. ââ¬Å"I expletive you Briar Rose. I curse youâ⬠This quotation mark demonstrates Rebeccaââ¬â¢s deficiency of comprehension of the fairy narrative. a fairy narrative Becca grew up listening to as an grownup. it embarks on a journey which takes its roots in America and leads to Poland and enables Becca to unveil the fairy narrative. It is through her solemn pledge that Becca commences her personal find and pursuit for her individuality. As she commences her pursuit to personal find she begins to unveil the faery narrative which is Gemmaââ¬â¢s fable of the hideous events in the Judaic holocaust that impacted 1000000s of Jews. who suffered at the custodies of the Naziââ¬â¢s. Yolen has successfully interwoven the allegorical construction in the narrative to convey the significance of personal find. Yolen has successfully demonstrated the technique of multiple narrative voices to exemplify her strong positions on personal find. It is through the intertwining of the voices of Gemma. Josef Potocki and Rebecca that the truth behind Gemmaââ¬â¢s yesteryear is unveiled. In peculiar the narrative of Potocki brings the horrors inflicted on the Jews to the head of the personal find. ââ¬Å"It was tremendous. full of shadows: shadows of weaponries. of legs. of caputs thrown back. oral cavities unfastened in silenced shrieks. â⬠Yolen captures the horrors expounded on the Jews efficaciously and makes the respondent tremble with fright at the evil enaxed by the Nazi soldiers. Potockiââ¬â¢s voice/narrative brings Becca closer to unveiling the enigma of Gemmaââ¬â¢s non-existent yesteryear. Josefââ¬â¢s history explicitly detailing the horrors of the holocaust is juxtaposed against Gemmaââ¬â¢s fairy tale. touching to the fact that such horrors are difficult to joint by the victims. In Briar Rose. Yolen has strongly conveyed personal find through impact and importance of oneââ¬â¢s cognition of household history to understanding an individualââ¬â¢s individuality. Yolen has basically embedded insistent duologue to positively convey personal find. Beccaââ¬â¢s journey on persona find is initiated by her resolute promise on Gemmaââ¬â¢s decease bed to happen the palace in the quotation mark where Gemma recites ââ¬Å"Promise me you will happen the palace. ââ¬Å"Promise me youââ¬â¢ll find the prince. Promise me you will happen the shaper of the enchantments. â⬠The repeat of ââ¬Å"promiseâ⬠is bewitchingly utilized to underscore and enable the respondent to understand the significance of the pledge. The composer efficaciously portrays this through Beccaââ¬â¢s tone when she says ââ¬Å"Iââ¬â¢m traveling to work out itâ⬠¦ The conundrum and the mysteryâ⬠¦ Iââ¬â¢m traveling to happen the palace and the prince and repossess our he ritage. â⬠It is the resoluteness with which Becca makes the pledge that the respondent comes to gain the significance of the pledge and that it is a cardinal message to the novel and through this individual event that personal find is set into gesture. This pursuit of personal find is reinforced and intensified by Beccaââ¬â¢s finding and strong bond with her grandma and allows the respondents to admit that it is the driving force behind her aspiration and digesting doggedness to detect the truth within the mystery of the fairy narrative. Yolen establishes the close connexion through Gemmaââ¬â¢s congratulations of Beccaââ¬â¢s devotedness to the fairy narrative when she says ââ¬Å"you ever understandâ⬠a trait that makes the respondents find Becca appealing. This has significantly influenced her picks and actions. as she embarks on the pursuit of personal find with the given secret wooden box that has ââ¬Ëbriarââ¬â¢ and a rose carved on its palpebra ( symbolism and repeat of the rose ) and filled with Gemmaââ¬â¢s ownerships indoors in order to repossess Gemmaââ¬â¢s heritage. Yolen has successfully demonstrated personal find through the usage of repeat in the text Briar Rose. Yolen has purposefully made Becca the heroine more appealing than her sisters Shana and Sylvia. Yolen has efficaciously demonstrated the importance of personal find in the text Briar Rose by implanting legion sophisticated linguistic communication techniques in her novel. The personal find undertaken by Becca. leads her to the nucleus of the holocaust. and brings to the head the experience of Gemma ; Yolen uses the fairy tale to make a sense of good versus bad. good versus immorality. Yolen through Becca makes the respondent gain the significance of personal find. The words of Stan competently sum Yolenââ¬â¢s positions on personal discovery- ââ¬ËWhat is past is prologueââ¬â¢ Ohttp://www.blogger.com/profile/12056608005377884137noreply@blogger.com0tag:blogger.com,1999:blog-9069031933139863891.post-58995743482601192692020-02-19T06:28:00.001-08:002020-02-19T06:28:03.333-08:00Sustainable Operations Management Essay Example | Topics and Well Written Essays - 2000 wordsSustainable Operations Management - Essay Example Its main focus is on the efficiency and effectiveness of the processes involved in value creation for sustainable development and growth. The term sustainability aims at keeping a balance between the human needs and prevention of the ecosystems on which our future generation depends. In specific, it refers to the exploitation of resources with the orientation of technological changes and minimal environmental damage to the present as well as future needs. The adoption of sustainable development theory is at an ever growing pace with the increased awareness of eco-friendly environment and analysis has indicated that since after the introduction of UN Agenda 21 (Moore, pp. 20-28, 2008), things seem to accelerate significantly in this area. In order to compete with the global market, businesses are paying more attention towards the environmental consequences of their products or services. They have realized the importance of operations strategy to support the companyââ¬â¢s objectives and corporate goals. This trend has transformed the nature of operations to green product design, triple bottom line reporting and close-loop supply chains (Lippmann, pp. 1-9, 1999). The involvement of operations management is present from strategic to tactical and operational levels. Its activities include ââ¬Å"site location, layout and structure, inventory management, traffic and materials handling, equipment selection and maintenance, designing technology supply chains, etcâ⬠(Metz, 1998). In this regard, this paper will focus on the issues companies confront while developing their policies regarding sustainable development (Moore, pp. 29-33, 2008) in the area of supply chain management. Supply Chain Management The term supply chain interchangeably used as ââ¬Ëdemand chainââ¬â¢ or ââ¬Ëvalue chainââ¬â¢ refers to the voluntary commitments made by the companies to manage better relations with the suppliers (Metz, 1998). It manages in three different directions: t he information flow in all the departments, the funds flow and the materials flow to the concerned places. As the aim of this assignment is to identify and discuss some of the key issues faced by the companies in the development of a sustainable supply chain policy, it has been an observation that companies have realized that the value they provide to their customers in the form of a product or service is not enough to survive in this competitive world (Webb, pp. 1-5, 2000). There is a constant need to address and resolve the sustainability issues throughout the supply chain. ââ¬Å"Some of the most popular and important approaches to SCM includes collaborative planning, outsourcing, customers-suppliers partnership and ISC (integrated supply chain) designâ⬠(OECD, 1999). In specific, there are three dimensions on the basis of which a sustainable supply chain policy is developed. Particularly, UN Agenda 21 (Moore, pp. 29-33, 2008) divided the dimensions in two categories: social and economic. However, this paper has identified environmental, social, and ethical concerns that directly affect the performance and image of the company. Environmental Issues: a) the use of natural resources b) gas emissions c) waste management concerns d) harmful substances e) energy consumption f) deforestation g) global warming h) ozone depletion i) Nuclear radiation. Social Issues: a) Role and responsibility of the company towards the social Ohttp://www.blogger.com/profile/12056608005377884137noreply@blogger.com0tag:blogger.com,1999:blog-9069031933139863891.post-16726147283225192302020-02-04T05:34:00.001-08:002020-02-04T05:34:02.407-08:00Eminent Domain Essay Example | Topics and Well Written Essays - 1000 wordsEminent Domain - Essay Example You are flustered, angry, dumbfounded, and at your wits' end! Why me! Don't I have the right to do what I like with my own property No, you don't! Not when you are up against eminent domain. The state government has enough powers under eminent domain to take over your property, pay you a 'just compensation' and raze your house to the ground and start with their redevelopment plans. (Karen Sudol) condominium, bigger business, hotel or retailer by which the exchequer stands to generate higher tax revenue, then the property in question comes within the purview of the statutory criteria for 'blight' in New Jersey for redevelopment and for the greater good of the public. Or if someone owns a farm or if the place was recently flooded, the government enjoys the right to seize the property to preserve open space and alleviate damages caused by natural disasters. There is little that the property owner could do other than go to the court. And the litigation can drag on for years! The government seizes the property after paying 'just compensation' which according to the disadvantaged owners is anything but just. The only ones happy are politically-connected developers who have everything to gain by eminent domain. The hapless property owner in New Jersey has almost nothing to fall back on by way of legal recourse. (Stop Eminent Domain Abuse). Nobody would have believed t... Suddenly, the azure, scenic location of the New Jersey waterfront are being consigned to the cutting and crashing sounds of monstrous, razing bulldozers. Thirty two blocks of homes and businesses have been condemned as areas deserving redevelopment plan for private purposes. The new landscape under the redevelopment plan will see condominiums, big retailers, hotels, golf courses, and the likes. While the Supreme Court has ruled in favor of eminent domain, the local residents, particularly the elderly who have spent their lifetime in the nostalgic precinct have reason to worry. And Ashbury Park is being keenly watched because nowhere else has eminent domain been arbitrarily pushed down the throat with such high-handed expression of legal enforcement. (Greetings from Ashbury Park) Need for Eminent Domain Sure, not everyone is complaining. A good number seeing the positive side, or just because they could not care less, have consented. The fence sitters did not see any point in fighting a protracted court battle, did not see any merits in fighting the battle even if they ultimately won it. The determined bid by politicians and developers was enough to deter any such prospect. At any rate, not everything envisioned in eminent domain looked bad. The area did look like it needed cleaning up a bit anyway. Then there are old, derelict houses infested with rats and are in fit or unfit enough condition to be demolished right away. Children and the elderly have quite often found themselves bitten by these rodents and it was unsafe particularly in the dark. The flip side of eminent domain is its commitment to preserve open space and redevelop with Ohttp://www.blogger.com/profile/12056608005377884137noreply@blogger.com0tag:blogger.com,1999:blog-9069031933139863891.post-9496189741392512972020-01-27T01:58:00.001-08:002020-01-27T01:58:03.719-08:00The Effectiveness of Bensonââ¬â¢s Relaxation TherapyThe Effectiveness of Bensonââ¬â¢s Relaxation Therapy ABSTRACT A study to evaluate the effectiveness of Bensonââ¬â¢s relaxation therapy on reduction of pain and stress among post caesarean mothers admitted in KMCH, Coimbatore Objectives of the study are, To assess the level of pain and stress among post caesarean mothers before intervention in both control and experimental group, To assess the effectiveness of Bensonââ¬â¢s relaxation therapy on reducing pain and stress among post caesarean mothers in experimental group and to find out the association between pain and stress with demographic and clinical profile. Time Series design was adopted for this study. Setting of the study is OBG wards in KMCH, Coimbatore. Sample size is totally 100 post caesarean mothers. (50 in the experimental group and 50 in the control group). Non probability purposive sampling technique was used. Titler et el(2004) effectiveness model was framed. Pain perception level was assessed by using 0-10 numerical pain scale, stress was assessed using Hungââ¬â¢s postpartum stress scale. Intervention: Pain was measured by numerical pain scale before and after providing the Bensonââ¬â¢s relaxation therapy for 3 consecutive days, twice daily. Stress was measured by Hungââ¬â¢s Postpartum stress scale, Pre test is done on the 1st day morning before intervention and post test is done on the 3rd day evening after intervention. Bensonââ¬â¢s relaxation therapy is effective in reducing the pain perception and stress in mothers who underwent LSCS. On comparing the pre test pain perception levels between the experimental and control group the ââ¬Ëtââ¬â¢ value was not significant at 0.01 level of significance in pre test 1 whereas it was significant in the rest five observations. Comparison of the post test pain perception levels among the experimental and control group showed that the ââ¬Ëtââ¬â¢ value was significant at 0.01 level of significance for all the six observations of post test. Hence there is a statistically significant difference in the post test pain perception scores in the experimental group. Similarly, on comparing the pre test stress scores in both experimental and control group the ââ¬Ëtââ¬â¢ value was not significant at 0.01 level of significance whereas the ââ¬Ëtââ¬â¢ value was significant on comparing the post stress scores among both experimental and control group, thus proving that there is a statistically significant difference in the post test stress scores in the experimental group. Conclusion: The results supported that Bensonââ¬â¢s relaxation therapy is a simple therapy of non pharmacological measure and is effective in reducing the pain perception and stress in mothers who underwent LSCS. This saying amplifies the focus on success and hinders the complexity of education. In The Allegory of the Cave, Plato exploits Darkness, intermediacy and Enlightenment to demonstrate education as a complex journey of achieving knowledge. Through exploring Allegory of the cave, the first stage of education is darkness. Darkness is figuratively where one is obstructed from gaining knowledge.Plato high lights this point and writes, ââ¬Å"ââ¬âhuman beings living in an underground den, which has a mouth open towards the light and reaching all along den; here they have been from childhood, and have their legs and necks chained so that they cannot move, and can only see before them, being prevented by chains from turning around their heads. â⬠(à ¶ 1) When the prisoners are in the darkness, this symbolizes their ignorance and lack knowledge. Although there is always a way that leads to gaining knowledge, there are obstacle s that prevent the prisoners from pursuing knowledge. The exit that leads to the ââ¬Å"lightâ⬠shows that there is a way that leads to gaining knowledge. The ââ¬Å"legs and necksâ⬠being bound demonstrates the obstacles that are preventing the prisoners from pursuing knowledge which limits them to be short sighted and only see what is ââ¬Å"before themâ⬠. Darkness is the initial stage in education that is hindering the prisoners from gaining knowledge. Darkness led to a stage of intermediacy that involves challenges and adjusting from ignorance to knowledgeable.Plato continues, ââ¬Å"ââ¬âif the prisoners are released and disabused of their error. At first, when any of them is liberated and compelled to suddenly stand up and turn his neck around and walk and look towards the light, he will suffer sharp pains; the glare will distress him and he will be unable to see the realitiesââ¬âââ¬Å" (à ¶ 15) When Darkness is figuratively gone and there are no obstacl e, the prisoner has a weak excuse not to pursue knowledge. When the prisoner is breaking from inertia by standing up, the prisoner experiences ââ¬Å"sharp pains. This reveals the resistance to change that the prisoner has from being ignorant to being knowledgeable. The ââ¬Å"glareâ⬠afflicting the prisoner announces that the prisoner was figuratively in darkness before and the ââ¬Å"distressâ⬠the prisoner experiences is the process of learning. The intermediate stage in education is a learning stage of adjusting from ignorance. Through intermediacy was the rise of enlightenment. Enlightenment symbolizes a phase where knowledge is gained and one is completely informed.Towards the end of ââ¬Å"The Allegory of the Caveâ⬠Plato writes, ââ¬Å"Last of all he will be able to see the sun, and not mere reflections of him in the water, but he will see him in his own proper place, and not in another; and he will contemplate him as he is. â⬠(à ¶ 23) In ââ¬Å"The All egory of the Caveâ⬠, the hierarchy of light shows the ââ¬Å"sunâ⬠to be at metaphorically the highest level. The prisoner having the ability to catch sight of the ââ¬Å"sunâ⬠reveals that he is enlightened, thus he has gained knowledge to comprehend. The prisoner also experiences a completely new perspective due to the knowledge he gained. Enlightenment is the final complex stage in education where one obtains knowledge. Throughout ââ¬Å"The Allegory of the Caveâ⬠, The process of achieving knowledge is through darkness, intermediacy and enlightenment. Darkness consists of barriers that interfere with one pursuit of knowledge. Intermediacy is a learning stage that leads to enlightenment of gaining knowledge. Plato affirmed education as a derange journey. Fast forward seventy two years and capital punishment is at its lowest rate in years, murder rates are at some of the lowest levels on record (Johnson). and Colorado governor Bill Ritter grants Arridy an unconditional pardon based on an ââ¬Å"overwhelming body of evidenceâ⬠and ââ¬Å"an admission of guilt by someone else.â⬠This is one of many cases where citizens have been executed for crimes they did not commit (ââ¬Å"Executedâ⬠). Consequently, concerns of the constitutionality and morality of the death penalty are at the forefront of public focus. According to the National Center for Victims of Crime, ââ¬Å"The criminal justice system is the set of agencies and processes established by governments to control crime and impose penalties on those who violate lawsâ⬠(ââ¬Å"The Criminalâ⬠). A quick judgment says that both of these purposes are effectively achieved through the use of the capital punishment system. Illegal drug trade is a worldwide black market consisting of production, distribution, packaging, and sale of illegal substances. Although todayââ¬â¢s War on Drugs is a modern phenomenon, drug problems have been a common problem throughout history. The market for illegal drugs is massive, when we consider the estimated global drug trade value is worth $321 billion (Vulliamy). The most drug trafficking happens on the border between Mexico and the United States. Former Mexican President Felipe Calderon said, ââ¬Å"Our neighbor is the largest consumer of drugs in the world. And everybody wants to sell him drugs through our door and our windowâ⬠â⬠¦show more contentâ⬠¦The government has made some gains, but at a heavy price. A total of 34,612 people have died in drug-related killings in Mexico in the first four years (Siddique). Most of these killing are between cartel rivals fighting for the control of territories. There are five cartels operating in Mexico: the Sinaloa, the Gulf, Juarez, Tijuana, the Zetas. The major cartels are the Gulf, Sinaloa and Juarez (Cook 21). Many of these cartels have joined together forming powerful alliances known as the ââ¬Å"Federationâ⬠(Cook 17). The cartels work together, but they remain independent organizations. Mexican Cartels are luring youngsters as young as 11 to work in their smuggling operations, attracting them with what appears to be easy money for doing simple tasks. Cartels recruit children, who are less likely to be suspects than adults and are easily manipulated by small sums of money, and face less severe penalties than adults. Kids are asked to smuggle drugs, people and weapons through the border. Steven McCraw, director of the Texas Department of Public Safety says, ââ¬Å"They are U.S. citizens who speak Spanish and blends perfectly in the other side of the border.â⬠There is not a concrete solution to dismantle the drug cartels. The United States has worked along with Mexico to fight and win the battle against the powerful drug cartels. They need to attack and stop the source of power. That source is the money. From what you have read of the novel so far and using relevant contextual information, give your response to the above view. The USA in the 1920s is remembered as the ââ¬ËRoaring Twentiesââ¬â¢, an age of new life, of hedonism and opportunity following the horrors the Great War. The decade is synonymous with wealth, materialism and unprecedented freedom. F. Scott Fitzgeraldââ¬â¢s The Great Gatsby provides an insight into the exciting and prosperous lives of the American people as they embark on the limitless potential of the American Dream and therefore it conveys a picture of 1920s American society. Withâ⬠¦show more contentâ⬠¦Similarly, the materialistic nature of the Christian festival of Christmas in the 21st Century has replaced most, if not all, of its religious meaning. Furthermore, consumerism is just as common in todayââ¬â¢s society as it was in the Roaring Twenties, thus Fitzgeraldââ¬â¢s picture of 1920s American society is relevant to modern capitalist readers. Social change in 1920s America was fundamental to the era earning the name the ââ¬ËRoaring Twentiesââ¬â¢. It quickly became the societal norm to enjoy lavish parties, excessive alcohol despite the prohibition laws and dancing to new rhythmic jazz music. The social change was most evident in the roles of women. Before the First World War, women were restricted to being homemakers. Few, if any, women were employed and they never attended parties without a chaperone. During the war, however, women had enjoyed new freedom as they worked in factories while their husbands and fathers were at war. This sort of work in heavy industry encouraged freer behavior and women began smoking and drinking in public and going out unchaperoned. Fitzgeraldââ¬â¢s depiction of Jordan Baker and Daisy Buchanan reflects the new woman of the 1920s. Indeed, even Jordan Bakerââ¬â¢s name is unisex, reflecting the changing roles of women as they defy societyââ¬â¢s expectations and enjoy more masculine pursuits. This new found freedom slipped into decadence, allowing parties such as Gatsbyââ¬â¢s to be much le ss reserved as Nick observes women falling back upon menShow MoreRelated Great Gatsby1497 Words à |à 6 PagesIn chapter 3 of The Great Gatsby Nick is invited to one of Gatsbyââ¬â¢s extravagant parties. The tradition is so named for the owner of the farm, Captain Hopewell, where over thirty mounds were discovered. Earlier studies focused more on the exotic grave goods such as precious metals, freshwater pearls, many of these objects had come from all corners of the continent from the Rocky Mountains to the Gulf of Mexico, and north to the mid-Atlantic coastline (some say Hopewellian influence reached Nova Scotia). Earlier scholars of the Hopewell (1950s through 1960s) were well aware of the influence of the Interaction Sphere, yet concluded that the Hopewell, in terms of lifestyle were a cult and had no influence on daily life. Later studies suggest otherwise, as more and more information surfaces along with new insightful interpretations. It is widely accepted that the Hopewell are the next generation of the Adena. That is to say that the Adena gave rise to the Hopewell, who had, as speculated migrated into the Ohio River Valley from Illinois. The Hopewell have been described as a more elaborate and flamboyant version of the Adena. Whether the Hopewell overpowered the Adena or simply mingled with and mixed into the culture, is not certain, yet there has been no evidence of warfare to support the former. The result was a cultural explosion encompassing a vast majority of North America east of the Rocky Mountains to the Atlantic coast. The Hopewell flourished in the Middle Woodland from 200 B. C. to AD 500. The environment was nearly what it is today. Temperate with lakes, streams, wetlands and flood-plains, the people took advantage of the seasonal weather in the Ohio River Valley via foraging as well as hunting and gathering. The cultivation of domestic strains of beans and maize was well on its way as it was implemented in small amounts, catching on later in the time period. The vegetation was a prairie/forest mix of deciduous trees, walnut, oak, various grasses and shrub. The fauna of the region included many species of waterfowl, turkey and other species in great abundance that are found today (perhaps in more abundance than found today). Larger fauna included buffalo, bison, deer, and elk and smaller animals such as rodents, raccoons, beaver and the like. Aquatic life included freshwater mussels and clams, many fishes (bass, catfish, etc.) and turtles. As we will see, the people made abundant use of these flora and fauna as food, clothing, container, ceremonial and ornamental objects. As for changes through time in the environment, it is theorized (by some) that it did in fact shift to a wetter one, perhaps driving the people to higher ground or otherwise drier climates. Core settlement, as noted was along the Ohio River and its estuaries on flood-plains, as well as on or near wetlands. Major areas of population density include Newark and Chillicothe as well as Marietta. These areas provided a lush environment of flora and fauna species that were widely exploited over the centuries by the inhabitants. Living quarters, although scarcely studied, consist of scatterings of small villages with larger settlements located near and around major mound complexes. Some of these smaller villages seem to have been occupied seasonally while settlement was more than likely permanent in the larger loci surrounding the mounds. Some dwellings have been found to consist of saplings stuck into the ground in a circle, brought together in the center and covered with elm bark or mats of woven grasses. .u1667743ef0cc7ea2a0d785bb487050bf , .u1667743ef0cc7ea2a0d785bb487050bf .postImageUrl , .u1667743ef0cc7ea2a0d785bb487050bf .centered-text-area { min-height: 80px; position: relative; } .u1667743ef0cc7ea2a0d785bb487050bf , .u1667743ef0cc7ea2a0d785bb487050bf:hover , .u1667743ef0cc7ea2a0d785bb487050bf:visited , .u1667743ef0cc7ea2a0d785bb487050bf:active { border:0!important; } .u1667743ef0cc7ea2a0d785bb487050bf .clearfix:after { content: ""; display: table; clear: both; } .u1667743ef0cc7ea2a0d785bb487050bf { display: block; transition: background-color 250ms; webkit-transition: background-color 250ms; width: 100%; opacity: 1; transition: opacity 250ms; webkit-transition: opacity 250ms; background-color: #95A5A6; } .u1667743ef0cc7ea2a0d785bb487050bf:active , .u1667743ef0cc7ea2a0d785bb487050bf:hover { opacity: 1; transition: opacity 250ms; webkit-transition: opacity 250ms; background-color: #2C3E50; } .u1667743ef0cc7ea2a0d785bb487050bf .centered-text-area { width: 100%; position: relative ; } .u1667743ef0cc7ea2a0d785bb487050bf .ctaText { border-bottom: 0 solid #fff; color: #2980B9; font-size: 16px; font-weight: bold; margin: 0; padding: 0; text-decoration: underline; } .u1667743ef0cc7ea2a0d785bb487050bf .postTitle { color: #FFFFFF; font-size: 16px; font-weight: 600; margin: 0; padding: 0; width: 100%; } .u1667743ef0cc7ea2a0d785bb487050bf .ctaButton { background-color: #7F8C8D!important; color: #2980B9; border: none; border-radius: 3px; box-shadow: none; font-size: 14px; font-weight: bold; line-height: 26px; moz-border-radius: 3px; text-align: center; text-decoration: none; text-shadow: none; width: 80px; min-height: 80px; background: url(https://artscolumbia.org/wp-content/plugins/intelly-related-posts/assets/images/simple-arrow.png)no-repeat; position: absolute; right: 0; top: 0; } .u1667743ef0cc7ea2a0d785bb487050bf:hover .ctaButton { background-color: #34495E!important; } .u1667743ef0cc7ea2a0d785bb487050bf .centered-text { display: table; height: 80px; padding-left : 18px; top: 0; } .u1667743ef0cc7ea2a0d785bb487050bf .u1667743ef0cc7ea2a0d785bb487050bf-content { display: table-cell; margin: 0; padding: 0; padding-right: 108px; position: relative; vertical-align: middle; width: 100%; } .u1667743ef0cc7ea2a0d785bb487050bf:after { content: ""; display: block; clear: both; } READ: The growth of Bitcoin Essay Post molds from various areas in Ohio and Illinois indicate oval patterns as well as rectangular long-houses with rounded corners. On April 10th, 1912, the Titanic left from Southampton, England with 2,227 passengers aboard bound for New York City. On April 14th, the ship struck an iceberg off the coast of Newfoundland and sank about 2 ? hours later. Passengers, mostly women and children, were loaded into lifeboats, however only 705 passengers survived as many lifeboats left partially full. Hans Peder Jensen and his fiance Carla Christine Jensen were passengers from Denmark on the Titanic. Hans Jensen was a carpenter and they had planned to settle in Portland, Oregon after arriving in the US. Hans Jensen did not survive and his body was never recovered. Carla Jensen was on lifeboat 16 and was rescued by Carpathia few hours after Titanic sank. Carla Jensen filed a lawsuit on behalf of Hans Jensen Estate against White Star Lines for the death of his fiance. Carla sued White Star Lines because the ship had struck the iceberg even though other ships had sent ice warning messages, which in turn caused death of her fiance. Carlaââ¬â¢s dream of settling in the US and start a new life with Hans was shattered. The story of what actually happened to Hans Jensen the night that Titanic sank was mostly true, even though there are some conflicting accounts by the witnesses. According to Carla Jensenââ¬â¢s information provided to her attorney, Hans Jensen was helping loading passengers into lifeboats when she last saw him. Second Office Lightoller, who was in charge of evacuating the passengers, provided his recollection of what happened that night. Lightoller had talked to Hans while he was helping loading the passengers and saw him getting into the collapsible Lifeboat D. However, when more women and children came, Lightoller asked others to make room and Jensen jumped out of the lifeboat. While the lifeboat was lowered into the water, two men jumped into the boat from another deck, but then he did not see Jensen again. Lieutenant Mauritz Bjornstrom Steffansson, another witness and one of the two men that jumped into Lifeboat D, however had a slightly different version of the story. He claimed that Jensen was actually drunk and was interfering with officers performing their duties, but he did keep the crowd away. Steffansson also said that he last saw Jensen when he got out of the lifeboat. Therefore, both witnesses stated that Hans Jensen voluntarily gave up his seat on the lifeboat and that was the last time anyone has seen him. Negligence: Hans Jensen Estate sued White Star Line claiming White Star was grossly negligent in its operation of the Titanic, resulting in death of over 1,500 passengers, including Hans Jensen. Compensation sought by the plaintiff was for emotional, physical, and financial loss suffered by Hans Jensen and Carla Jensen. The compensation claimed was for: 1) Hans Jensenââ¬â¢s death, 2) the physical injuries and suffering he had to endure as he was frozen to death, 3) the anguish Jensen would have felt knowing that he was going to die, and 4) financial loss of wages he would have earned as a skilled carpenter. In order to claim negligence, the plaintiff must prove that the defendant owed a duty of care to the plaintiff, the defendant had breached the duty, the plaintiff had suffered a legally recognizable injury, and the injury was caused by the defendantââ¬â¢s breach. According to tort law, the duty of care is measured by the reasonable person standard, which is normally defined as what a person with ordinary care would do or not do under similar circumstances. Once defendant is determined to have breached the duty of care, the plaintiff must prove he or she had suffered some kind of loss, harm, wrong, or invasion of protected interest. Another important element is whether there is causation between the breach of duty and the plaintiffââ¬â¢s injury. The first element of negligence is duty of care. According to the plaintiff, White Star Line, which owns and operates Titanic, owes a duty of care to all of the passengers on the ship. All of the passengers relied upon White Star Line to take them to New York safely. Therefore, the crew on Titanic owed duty of care to not only provide food and comfort, but more importantly safety to the passengers. Breach of duty occurs when defendantââ¬â¢s action has created risk of harm to others. In this case, the plaintiff believes that the crew of the Titanic behaved in unreasonable manner in many ways. The actions of the crew members resulted in the Titanic struck a large iceberg and eventually sank causing large casualties, so the duty of care was breached. Whether the breach of duty has caused the plaintiffââ¬â¢s injury is the third element of negligence. Requirements for causation are causation in fact and proximate cause. Causation in fact is determined by the ââ¬Å"but forâ⬠test, which means if it was not for the defendantââ¬â¢s breach of duty, harm or injury would not have occurred. Proximate cause is when the connection between the action (breach of duty) and the injury is strong enough to impose liability. Another issue that needs to be considered is foreseeability because the defendantââ¬â¢s action must have created a foreseeable risk of injury. In this case, the crew of Titanic was navigating the ship during the night at high rate of speed in water with iceberg, so the risk of the ship hitting an iceberg and causing casualties can be foreseen. In addition, Plaintiff has to show proof of actual damage caused by the defendantââ¬â¢s actions. The damages claimed in this case by the plaintiff are loss of Hans Jensenââ¬â¢s life, pain and suffering from freezing to death, mental anguish Hans suffered knowing he is going to die, and loss of wages as a carpenter. The plaintiff was seeking compensatory damages as well as punitive damages from the plaintiff for gross negligence in operating the Titanic, causing major loss of life. Defenses to Negligence: The three defenses to negligence are assumption of risk, superseding cause, and contributory negligence. Assumption of risk is when the plaintiff has knowingly and voluntarily enters into a risky situation. If an unforeseeable intervening event occurs that break the causal connection between a wrongful act and the injury, then the superseding cause can be used by the defendant to mitigate the liability for the injury. Finally, contributory negligence can be used as defense if the plaintiffââ¬â¢s own negligence had contributed to the injury. The following are the White Star Lineââ¬â¢s defense arguments: First, White Star Line claims that Hans Jensen has voluntarily chosen to step out of Lifeboat D, while everyone that was on the lifeboat survived. Jensen did not have to leave the boat when more women came as there were still empty seats when the boat was lowered. So, the defendant argued Mr. Jensen had ââ¬Å"assumed the riskâ⬠when he had knowledge of the risk or danger by not staying in the lifeboat. Jensen should have understood the risk and danger, but he exposed himself to that risk as he had given up the seat he occupied. Both Office Lightoller and Lieutenant Bjornstrom-Steffansson are witnesses who have interacted with Jensen and have seen Jensen getting out of the lifeboat voluntarily. In addition, White Star Lines claimed that the actions of passengers on the Titanic created superseding cause. When passengers became unruly and uncontrollable, Hans Jensen tried to control the passengers even though Office Lightoller informed him it was not necessary, as a result the lifeboat left without Jensen. Therefore, the defendant argued that the actions of passengers had caused Jensenââ¬â¢s death and superseded the alleged negligence on White Star Lines. Contributory negligence due to plaintiffââ¬â¢s own action serves as complete defense to liability for negligence. In this case, White Star Lines claimed that Jensen may have disregarded crewââ¬â¢s direction or was not acting in a reasonable manner at all times due to his drinking, which contributed to his death. Jensen had informed Officer Lightoller that he did have couple drinks for his birthday according to Lightollerââ¬â¢s testimony. Under New York law at the time, any negligence attributable to the plaintiff prevents recovering compensation from the defendant, even though the defendant may have been negligent. Conclusion: Based on the facts of this case, my verdict as a juror is in favor of the plaintiff. White Star Linesââ¬â¢ negligence was the cause for the death of Hans Jensen. The crew of Titanic owed duty of care to its passengers for taking them to New York safely, however that duty of care was breached when the ship had struck an iceberg and sank in the Atlantic Ocean. Titanic had received ice warnings from four other ships, but the warnings were ignored and the ship was traveling at high speed at night when the ice would not be clearly visible from a far distance. The risk of the ship hitting the iceberg could be foreseen. Also, the crew did not properly conduct the evacuation operation as many of the lifeboats left partially full. More passengers could have been saved if the lifeboats were loaded to its full capacity. If it was not for the sinking of the Titanic, Hans Jensen would not have died at such a young age of just 21 years old. The connection between the breach in duty of care and the resulting loss of life is strong enough to warrant liability. The plaintiff did suffer legally recognizable injury, both physically and emotionally, as a victim of this tragedy. Carla Jensen, who is the legal heir to her fianceââ¬â¢s estate, also suffered emotional distress as she has lost the person who was going to support her life financially. All four elements of negligence are present in this case, therefore White Star Lines should be deemed as liable for the death of Hans Jensen. The defendant has raised the issue of assumed risk as defense to this case. It is true that Hans Jensen had voluntarily given up the seat on the lifeboat; however he was not the only one who has gotten out of the lifeboat to make room for the women. In emergency situations, risks are not deemed to be assumed. This situation definitely qualifies as an emergency, so the assumption of risk defense cannot be applied in this case. There were empty seats left on the lifeboat, so Jensen could have jumped back into the boat. But Office Lightoller had lowered the boat before it was full, so Jensen may not have had the time or chance to get back into the lifeboat. If the crew of Titanic had properly handled the evacuation process, then the passengers would not have became uncontrollable and required Jensenââ¬â¢s intervention, therefore this does not qualify as superseding cause that contributed to Jensenââ¬â¢s death. Finally, there is no concrete evidence that Jensen was intoxicated and behaved in unreasonable manner; therefore contributory negligence cannot be applied in this situation. Based on the above analysis, White Star Lines, as owner and operator of Titanic, should compensate the Estate of Hans Jensen for the death and suffering Jensen had endured as result of this tragic incident as well as loss in wages Jensen would have earned as a carpenter in the US. Celsius Temperature Scale The Celsius temperature scale is also referred to as the centigrade scale. Centigrade means consisting of or divided into 100 degrees. The Celsius scale, invented by Swedish Astronomer Anders Celsius (1701-1744), has 100 degrees between the freezing point (0 C) and boiling point (100 C) of pure water at sea level air pressure. The term Celsius was adopted in 1948 by an international conference on weights and measures. Anders Celsius Anders Celsius was born in Uppsala, Sweden in 1701, where he succeeded his father as professor of astronomy in 1730. It was there that he built Swedens first observatory in 1741, the Uppsala Observatory, where he was appointed the director. He devised the centigrade scale or Celsius scale of temperature in 1742. He was also noted for his promotion of the Gregorian calendar, and his observations of the aurora borealis. In 1733, his collection of 316 observations of the aurora borealis was published and in 1737 he took part in the French expedition sent to measure one degree of the meridian in the polar regions. In 1741, he directed the building of Swedens first observatory. One of the major questions of that time was the shape of the Earth. Isaac Newton had proposed that the Earth was not completely spherical, but rather flattened at the poles. Cartographic measuring in France suggested that it was the other way around - the Earth was elongated at the poles. In 1735, one expedition sailed to Ecuador in South America, and another expedition traveled to Northern Sweden. Celsius was the only professional astronomer on that expedition. Their measurements seemed to indicate that the Earth actually was flattened at the poles. Anders Celsius was not only an inventor and astronomer but also a physicist. He and an assistant discovered that the Aurora Borealis had an influence on compass needles. However, the thing that made him famous is his temperature scale, which he based on the boiling and melting points of water. This scale, an inverted form of Celsius original design, was adopted as the standard and is used in almost all scientific work. Anders Celsius died in 1744, at the age of 42. He had started many other research projects but finished few of them. Among his papers was a draft of a science fiction novel, situated partly on the star Sirius. If youââ¬â¢re writing a novel, youââ¬â¢ve probably created an awesome, vivid protagonist in your head: motivated, quirky, maybe even memorably named. But how do you convey all that to a reader without depleting the magic?Writing strong character descriptions actually requires quite a bit of finesse. If you skimp on descriptive passages, you run the risk of leaving your readers with forgettable characters. But if you get too descriptive, you wind up leaving no room for the readerââ¬â¢s own imagination. So what does it take to strike the right balance? Weââ¬â¢ll tell you! Here are three cardinal rules on how to write character descriptions without falling off that tightrope. Do you know the three cardinal rules for describing characters? Find out in this guide! 1. Choose your words carefullyWhen writing character descriptions, itââ¬â¢s easy to get ahead of yourself. After all, this is the first time youââ¬â¢re introducing a character youââ¬â¢ve created from the ground up.But just because you know everything about them, doesnââ¬â¢t mean the reader needs to. Character descriptions arenââ¬â¢t about doling out every detail in lavish language - theyââ¬â¢re about succinct characterization. Here are a few tips on how to achieve just that.Be descriptive in your languageWeââ¬â¢re talking about character descriptions, after all - itââ¬â¢s quite literally in the name. When describing a character that you see clearly in your mind, itââ¬â¢s easy to simply give a laundry list of attributes: she had black hair, brown eyes, and freckles. But that tells us nothing about the character and is frankly a waste of words.Sure, your protagonist might have brown eyes. But so does half the worldââ¬â¢s population! And characterization is all about showing what makes a character unique.Sometimes, this can be done through word choice alone. Take this example from Huckleberry Finn:ââ¬Å"There warnââ¬â¢t no color in his face, where his face showed; it was white; not like another manââ¬â¢s white, but a white to make a body sick, a white to make a bodyââ¬â¢s flesh crawl ââ¬â a tree-toad white, a fish-belly white.â⬠From this passage, we clearly understand how Huckââ¬â¢s father looks, as surely as if Twain had simply written, ââ¬Å"He was white.â⬠But through the use of figurative language and excellent word choice, another image sticks in our head: that of a sickly, grotesque drunk. Bonus points for the use of ââ¬Å"tree-toadâ⬠and ââ¬Å"fish-bellyâ⬠- descriptors that match the tone of the adventure novel.Use adjectives sparingly Feel free to stretch the boundaries of what youââ¬â¢re describing and how youââ¬â¢re describing it. Rather than simply pointing out concrete characteristics or actions, feel free to describe abstractions, like this passage from Neil Gaimanââ¬â¢s Neverwhere:ââ¬Å"Mr. Croup likes words, while Mr. Vandemar is always hungry. Also, they look nothing alike.â⬠Or, describe physical characteristics in an abstract way - that is, use similes and metaphors. In A Christmas Carol, Dickens does not describe Scrooge as a Christmas-hating miser. Instead, Scrooge is:ââ¬Å"Hard and sharp as flint, from which no steel had ever struck out generous fire; secret, and self-contained, and solitary as an oyster.â⬠How did Dickens turn Scrooge into a Christmas-hating miser without ever calling him one? Be biasedWhether youââ¬â¢re describing yourself to a friend or a friend is describing you to someone else, itââ¬â¢s very unlikely either of you would give a painstaking, perfectly objective account.. Biases exist in every aspect of life, so itââ¬â¢s okay to be biased in character descriptions, too.If a first person narrator is describing themselves, they might comment on their own attractiveness, like Humbert Humbert in Lolita:ââ¬Å"I was, and still am, despite mes malheurs, an exceptionally handsome male; slow-moving, tall, with soft dark hair and a gloomy but all the more seductive cast of demeanor.â⬠Or you could have one character describe another, which illuminates the attributes of the latter and the perception of the former. Take, for example, this particularly scathing description of one person by another from Jodi Taylorââ¬â¢s The Nothing Girl:ââ¬Å"The only talents he possessed were delusions of adequacy.â⬠This sentence succinctly describes a not-quit e-self-aware underachiever. But it also illustrates a narrator with a not-so-objective opinion of him.Show, donââ¬â¢t tellYup. The golden rule of writing applies here as well. At the end of the day, no matter what you decide to reveal to your audience, the most important aspect of character descriptions is how you reveal it. Regardless of how special, unique, or honest-to-god awesome your protagonist is, a reader forced to trudge through page after page of intensive description will find any character boring.Instead, think of how we learn things about other people in real life. Very rarely does the color of our eyes or the shape of our nose describe who we are. We donââ¬â¢t tell everything there is to know about each other - we show it, through our expressions, perceptions, actions, preferences, and even our stuff. Apply that same rule to your character descriptions, and your characters (and readers) will thank you for it.Are there any character descriptions that stand out to you? First, it results into low operation cost if properly implemented. Customer relationship management also ensures increased profitability for the firm. CRM has high potential to increase the efficiency communication within the firm and promote team work within sales department as well as the entire organization. Implementation of CRM ensures that the company is capable of adapting to the emerging customer needs as the clients of the organization undergo customer life cycle. It equips the company with essential tools to counter changes in buying pattern and consumption behavior of customers. Sales force automation (SFA) is a CRM approach that streamlines all the stages of sales process, which ensures that sales representatives spend the lowest time possible in each sales phase. The software permits the organization to utilize the lowest possible number of sales representatives to manage clients and customers as well as attracting new lot of customers to the existing customer base of the organization. Contact management system incorporated in the software allows the system to follow and document all the phases of sales process for every customer of the company from the first interaction to present engagement. SFA also enables the company to discover opportunities, make sales prediction, and determine suitable market niches as well as establish workflow mechanization. CRM technology enables the company to develop, delegate and manage the needs of customers. Creating call centre software ensures that customers get the best support service from customer care agents of the company at the right time and hence increases customer satisfaction, which is a key pillar for creating customer loyalty. The renewable energy includes the energy sources that can be that can be used over and over again. It includes energy sources such as solar, geothermal, wave and wind energy, amongst other self-sustaining alternative energy sources. However, in order for renewable energy to be sufficient, large amounts of sources need to be harnessed, since they produce a relatively little energy. In other words the ratio of the energy produced to the energy source harnessed is relatively small compared to the non- renewable energy, whereby a small amount of the energy source produces substantial amount of energy. However, once used, these sources are irreplaceable (Schaeffer 2007). These include coal and petroleum products amongst others. They are a major cause of environmental degradation through emission of green house gases in to the atmosphere, and water pollution through oil spills as well as land degradation through mining of coal. The first and most important thing that each person ought to do in order to conserve the environment is to minimize the use of non-renewable energy. This will help in reducing the rate of environmental degradation through energy production from non-renewable sources. This can be accomplished through the use of solar energy for lighting, wind energy, and natural gas among other renewable energy sources. Electrical appliances, especially the air conditioners, refrigerators and lighting should remain switched off whenever they are not needed. People should also use energy efficient equipment such as less fuel consuming vehicles or the use of bicycles instead of vehicles that consume high energy as well as emitting green house gases to the environment. People should also insulate their living rooms more in order to minimize heating Ohttp://www.blogger.com/profile/12056608005377884137noreply@blogger.com0tag:blogger.com,1999:blog-9069031933139863891.post-17692849326094198082019-11-17T04:15:00.001-08:002019-11-17T04:15:05.266-08:0019th Century America Essay Example for Free 19th Century America Essay Social Studies Essay Throughout the 19th century, America was a rapidly growing country. It was full of new inventions, new ideas, economic and social development, and new ways of thinking. But, most of these came from the North. The North and the South had many differences and many similarities. The North and South had many differences. One difference is that Southââ¬â¢s economy relied on slaves more than the North. Almost all the Northern states immediately or gradually abolished slavery after the Revolutionary War. Another economic difference is that the Southââ¬â¢s economy was based on ââ¬Å"cash cropsâ⬠. ââ¬Å"Cash cropsâ⬠include rice, tobacco, indigo, and cotton. The South had many plantations to support its farming economy. The North had many small farms as well as larger towns and cities. The North relied more on factory work. In the North, railroads and canals connected the states, allowing for greater economic development. The Southââ¬â¢s social development was also very much different from the Northââ¬â¢s. For example, in the South, the wealthy plantation owners and the slave owners were at the top. They supported their plantations with slavery. In the North, the upper class was made up of mostly city people who owned factories. Many of the factory workers were European immigrants. One example of a similarity is the class structure. They both had a very small upper class, a small middle class, and a large lower class. Another example is that the white men had all the power, and slaves and women didnââ¬â¢t have equal rights with the white men. In terms of economic similarities, farming was an important part of the economy in both the North and the South. These two regions obviously had many differences. In many ways, this strengthened the nation. The Northââ¬â¢s factories processed the Southââ¬â¢s crops, which tied the nation together. Also, having male dominance and having women and African Americans with no equal rights kept the nation together. But, these differences also created conflicts, which threatened the nation. The North wanted to abolish slavery for good, but the South needed slavery for crops, such as cotton. Because of this conflict, the Civil War would start later on. Overall, both regionsââ¬â¢ differences threatened the nation. When the cotton gin was invented, this caused further conflict. It gave the South more reasons to keep slavery. Another conflict was the difference in wealth between the North and the South. The North had a more developed economy with canals, railroads, and factories. The South continued to rely on agriculture as its main component of the economy, requiring them to import manufactured goods. In conclusion, the North and the South were, overall, very different, but with some similarities. These differences strengthened the nation in a few ways and threatened the nation in many ways. The differences in social and economic structure led to the Civil War. Elections are the choice microphones for many citizens. There on Election Day, they have the right of making their voices heard; however, many interest groups and a few individuals seem to have a louder voice due to campaign financing: No U.S. official should be beholden to one or a few groups. And no group or individual should have a greater claim on our elected leaders than any other. Thatââ¬â¢s the way it should work. But it is growing clear to more and more Americans that it doesnââ¬â¢t (McCarthy 24). Recently, it has been the trend to try to make sure the opinions and concerns of minorities are duly noted and pondered on. The only problem seen with this comes about whenever the minority ââ¬Å"buyâ⬠the attention of politicians. Typically, minorities are more than a number. The grossly rich, while small in number and percent, have never counted as a minority, but these are the only ones who can afford to give enough support to a candidate to draw attention to them. Again, we see an aristocratic government. Even interest groups of true minorities canââ¬â¢t give enough to impress anyone. Now that we have seen the dangers of campaign financing, we should go back and find out how it started. Max McCarthy speaks of a time when everything got worse in politics. This was not to imply that everything had been perfect before, but once the media gets involved, things tend to go differently. Many years ago, the media began to play a vital role in the political education of our citizens, with radios and televisions. Before, only those with real authority had any complete knowledge of what went on with governmental politics. As each candidate was brought closer and closer to the American people, they actually started to care about things that before were nicely kept secrets. The opinions of these, now seemingly real people, instead of future historical figures, were actually heard, and the people actually knew who they were voting for. With the start of this new technology, campaigning was much easier; all that was needed was enough money to get the name recognition: As campaign costs have skyrocketed in recent years, the percentages contributed by the parties and small individual donors have declined . . .
